The $35M is chump change. The threat (presuming the decision stands) is that EBAY will be prohibited from continuing to violate the patents. Which is to say that they either have to shut down programs which bring in 30% of their revenue or they have to buy patent coverage. What do you suppose they will be charged for that? Orders of magnitude more than $35M I would presume. The patent owner currently has them nicely wedged between a rock and a very hard place indeed. What would you charge EBAY to keep 30% of their business alive if you owned the patents?

The question of course, IMHO, is whether the decision stands or not.
