Actually, I'm not arguing against you and the fact you feel that way suggests something about you. I simply stated my sense that the issue was one of framing before it was that of the relevant case law. You disagreed with your usual sneer. Fine. Then you need to demonstrate. You feel you have but the issue is whether you have the right cases, whether you quoted the cases correctly, whether the context would say something different, what other arguments might be relevant. And so on.

If you would drop the sneering, I would thank you for doing that work. And admit that were I seriously interested in this conversation, I would track down the case books, etc. The links would have cut that time demand down and put it within the realm of the doable. Without them, it's more than I care to devote to this discussion.

Another project of mine has grabbed my attention over the past month or so and left me little time for serious posting here. That project came to a very successful conclusion last night. Now, I've got to spend a couple of days catching up with life, a very long weekend at the Jersey Shore, and then back to regular life sometime around the middle of next week.

If this conversation still interests me, I'll check back in and see what I can find that strengthens your argument or mine.
