tejek, re:You keep missing or ignoring the operative words to a hate crime And you keep missing the operative word crime, a crime has already been committed and you want to then see if another crime "hate" which by itself is not a crime has also been committed. That's why I made the comments earlier about "passion" crimes, lot's of folks get murdered due to that emotion. There is no law against passion that I know of. You're basically saying you what to create Bias laws, sort of like some bizarre form of Affirmative Action for crimes based on something which by itself is not illegal - "hate". Can you think of an example where hate is a crime without an act which is also a crime like murder? If Justice was truely blind we wouldn't use motive in determining sentences - but we don't work that way.
