I think the higher number is in the cards. But, that's what makes the horse race! Remember, they have about 3 or 4 Dem Senators that will join them on stopping a filibuster, so they just need to get to 55 or so.

I don't see these olive branches being held out by the Dems as an altruistic move. They know they are in trouble with the public if they are seen as just obstructionists. Bush's ability to fund raise so easily is partially due to his toughness on the Judges. I don't think he is interested in a compromise candidate. In any case, It does not look like we will see an opening this year. Too bad. It would have made for some interesting fireworks.

I think filibustering Estrada is going to backfire on the Dems. The Latins are showing about a 90% position for Estrada being approved. Watch for the Repubs to really use this in Latin areas in next year's election.

Daschle Seeks Consensus on High Court Nominees

A little pre-positioning for the great court fight of the summer of 03. Who wins the "we were seeking harmony, consensus, and the other guys were just ideologues" public opinion fight?

Will be fun to watch, if something comes open. And if Bush thinks by putting up a Scalia type, he gains votes or, more likely, strengthen his base so he can move away from them in the general election race.

Note: Re the Supreme Court: Did the Repubs get anything like the kind of candidate they wanted when the Dems last had the opportunity to put someone forward for the Court? I don't remember Douglass being anything other than VERY liberal.....
