I don't think this would be necessary as I see things being self-regulated. For example, I expect that if we institute a loser pays system in America a few losers will end up suing their lawyers to reclaim whatever money they had to shell out to the other party, asserting they were either not adequately represented or were not reasonably apprised they didn't have a good case to prevail on their charges. This, in turn, would make lawyers less likely to take on frivolous cases brought by overzealous, misguided, or deluded clients.
