Yes. It all started with FDR. I was thinking yesterday, "we don't have a term for a Judge-run Government, but that was where we were heading."

When you get laws made by the Courts, it is fiat Government, and the polarization of the country is complete. Knocking down laws they don't like is one thing. Making laws they like, instead of saying, "that's for the legislature to decide," is another.

This ruling didn't merely overturn a statute. It created law. As O'Connor stated in her opinion, the statute could've been narrowly rejected on equal protection grounds. Kennedy created a rule out of thin air where none existed before, and in spite of precedent. That is legislating from the bench, and it is blatantly in violation of seperation of powers.
