I think most legislation provides that judges are allowed versus being required to impose sanctions. But, as you said, it's a tough thing to establish which means it would be tough to legislate and tough to impose in an evenhanded manner.

Nonetheless, since it's the fattening of the wallet that encourages some lawyers to push these cases through the system, a -meaningful- threat of thinning of those same wallets would seem to be the best deterrent.
