Hmmm, that's a not so interesting spin, uw. It's not a dem versus rep issue; rather the national consensus, as reflected in the Supremes decision, is for affirmative action and against untoward invasions of privacy. If you look at the Supremes decision, say the privacy issues, three Rep appointees were opposed to privacy and four were in favor; on the affirmative action case, four Rep appointees were opposed and three were in favor. Hard to make a case there of Dem versus Reps.

Will Bush attempt to convert it into a Dems versus Rep issue and further divide the country? Hard to tell.

Bob Novak, in his most recent column, suntimes.com argues that the next steps for the court will be that Rehnquist will retire, O'Connor will be appointed Chief Justice, a sort of interim appointment, and Gonzalez will be recommended to take Rehnquist's seat. That suggests Bush is backing away from a confrontation. Novak's sources on these sorts of things are usually quite good. Which doesn't mean that's the way it will happen. But it's something to watch.

If it goes that way, Bush will avoid dividing the country on this point.

As for picking the fights they can win, the Dems are the same as the Reps. If you wish to pick fights you need to become more ideological, head for political purity and start advancing fights you can't win. I do that a lot and would be happy to offer advise from my experience.

Much of your post is the classic us/them that has unfortunately become such a staple of politics in our time. Our guys are the good guys, yours are not; our guys are the moral guys, your guys are not; our guys are the American guys, your guys are not. It's too bad. I'm sorry to see it get repeated constantly.
