Jury Rules for Applied Materials in Axcelis Lawsuit
Wednesday July 2, 4:06 pm ET

SANTA CLARA, Calif.--(BUSINESS WIRE)--July 2, 2003--Applied Materials, Inc. today announced that a jury in the United States District Court for the District of Massachusetts ruled in favor of Applied Materials, returning a verdict that Applied Materials' SWIFT(TM) ion implantation system does not infringe a patent owned by Axcelis Technologies, Inc. In January 2001, Axcelis had filed suit against Applied Materials asserting that Applied Materials' SWIFT machine infringed Axcelis' U.S. Patent No. 4,667,111. By its verdict, the jury rejected Axcelis' contention.
"We are very pleased with the jury's decision. A team of talented and dedicated scientists developed Applied Materials' SWIFT ion implantation system with many new and innovative ideas that have been awarded several patents," said Joseph J. Sweeney, group vice president, Legal Affairs and Intellectual Property. "The jury verdict confirms that Applied Materials' innovative SWIFT ion implanter does not infringe Axcelis' patent."

Re: 1. There hasn't been a "lack of fab investments."

How about "there hasn't been an adequate round of fab investments to prepare for an eventual upturn?"
