The SC is part of "the Feds". If they can make any decision they want to then it is taking power from the states and giving it to the feds.

And the general president that the principles and words of the constitution can be cavalierly tossed aside when it is popular to do so doesn't always give more power to the people over their own individual lives. In fact I would say a firm commitment to the rule of law is more likely to increase individual freedom.
