I'm more interested in the principle than the issue. In principle, does a local jurisdiction have the right to express the prevailing morality in its laws? I think except for cases explicitly defined in the Constitution ( eg. race ) the community should have wide latitude to proscribe what it wishes. A thin majority on the supreme court thinks THEY should decide - on a case by case basis.

Now if you want to add a sexual preference protection to the Constitution, go for it.
