In practice most affirmative action seems to amount to preferences. Either directly in that the affirmative action scheme is a preference scheme by design, or by providing incentives and/or punishments that push people to hire according to race (or whatever else the affirmative action scheme is about).

An example that isn't a racial preferences scheme (and also isn't imposed by the government) would be the NFL's requirement that teams looking for new coaches interview minorities. This doesn't create any injustices or constitutional questions but it can be a bit silly because frequently the team already knows who it wants to hire even before the previous coach is let go. The interviews are just window dressing any everyone knows it.
