But you are not relying on your allegation to prove the fact in that case- you stipulate the fact right up front. Suppose you allege a murder but we don't know if it actually happened the way you allege (which is the way or murders). The allegation merely puts the idea of a murder, the way you allege it, into our minds, it doesn't do anything to prove the fact. That is why we need the jury - the trier of facts- to test your idea, your "allegation" - which is not real in and of itself, except as your allegation. We don't just say "Ah, the allegation here is a real thing, so OFF With His Head!" The problem with your case is that the allegations that you offer for Iraq are now being tried, by the public and the press, and I have to tell you, it doesn't look good for your "case". IMO
