You know what does upset me quite a bit, SI Poet Laureate - and thank-you for your well-wishes, they mean a lot - is that when individuals and companies such as the defendants in my case abuse the wonderful invention of the Internet in order to conspire to lie, cheat, steal and deceive thousands, it makes it very difficult to believe in the honesty and good will of others here, and I know that there are so many.

If I have ever exchanged difficult words with anyone here and was mistaken in a suspicion or judgment, then I ask you to forgive me for doing so, and understand that with 100+ fake aliases here from the defendants, the extraordinary lengths they have gone to first perpetrate their crimes, and second to perpetuate them, that perhaps I do deserve leniency in being somewhat circumspect about whom I trust. That is among the worst things the defendants did: they made us no longer trust one another, when that is how we began, individuals coming together, true access to the markets, a real chance after the 1996 revelation of the NASDAQ Price Fixing Scandal. That promising beginning was taken away from us. In the end, I do hope my case in some small way helps return us to that promise - and I'm not talking bubbles. Just a free and fair opportunity to be a part of our great securities markets, and to enjoy our colleagues as we did then.

I remember those times, even times when the markets were very difficult to trade, I remember so many good people, so much humor, so much talent. And then a few swinish cretins conspire to wipe it all out.

I truly hope the Court of Appeal refers criminal charges of perjury against Philip Berber and Christopher Rea to the San Francisco District Attorney and the California State Attorney General. I hope they are indicted, convicted, and sent to prison. They richly deserve it. maybe that will send a message to others who might try on what they did.

I know many are wondering why keep this case in the public eye, why post. It's because this case is more than about money being returned to me and others; it's about sending a message to those who constantly interfere in the transparency and fairness of the markets, after all the ideals set long ago that made this country great. We don't have to accept this garbage from a few blowing it for us all.

That's my speech, anyway. I hope we do get a fair shake in the Courts, and things change for the better.

If you look at the metre of this post - OK, not a sonnet or a haiku even, but pretty darned decent imagery I must say indeed - you will recognize the care it took to get the beat, the timbre just so, just right. My favorite is the dropping of the article in "you are delusional fool." "A delusional fool" just would never have packed the punch this did here...

You just can't top this kind of thing. Even Jenna, saying I was "a mosquito I can't swat" doesn't quite reach this level of a "scurry[ing] cockroach." I love it. I will never, ever forget that post. I am tempted to quote it at trial. Maybe I will. One thing, what he said, that the jury would be "bored." Somehow, with characters like these, I highly doubt it.

I've got my hands full with this case but I think tomorrow I'm going to share with you guys what I've learned about the markets as a result of my experiences. There are practical applications to knowing what not to do, what the brokers and sites who are trying to manipulate you want you to do. You do the opposite and you are on to something. I hope it will be of some value.

Disclaimer, though: my days making recommendations are gone and over. It will be strategy only, concepts I hope you all will develop further on your own.
