I know that as a fact. I have spoken to Kerry's top guys about it. It's 100% a Heinz issue. Kerry has no control or involvement in the Heinz foundations. And Theresa Heinz had not enough power to unilaterally fire Ken Lay prematurely from his position on one of the boards. So they let him finish out his term. Remember, except for Theresa now, all the Heinz trustees are Republicans and probably Bush supporters. That also makes them Ken Lay supporters. Ken Lay's former right-hand woman is now Bush's top female fundraiser. Nothing much has changed there.
