Murder is the unjust killing of innocent persons with malfeasance. Your claim of capital punishment being murder is not supported at all by your argument. You have made a case for raising the standard of proof beyond a shadow of doubt.

The state justice system is in place to resolve crime. Revenge or forgiveness is very individual and generally a view point.What business does the state have forgiving criminals? What about the man who raped my little girl in front of her brother before sodomizing him and killing their mother (not an actual example). Should the state forgive this man. If he is forgiven, then there is no reason that he should not be allowed to return to my community with the rest of my friends and family.

I agree that the state justice system should not be victim-oriented or perp-oriented. It should simply be a system of resolving crime. Some crimes are so irreconcilable that they are termed “heinous.” In this case a limited human justice system (which is all we will ever have) is not capable of recompensing the loss, reconciling the disputants, or resolving the criminal issues. If you have an idea on how to resolve heinousness then take responsibility and do it. You have not done that so far. Simply stating that you don’t like to think about death as an outcome is meaningless. We are all going to die. The alternatives that are currently in place to deal with heinousness are not just. Any treatment of a heinous criminal is irresolute making it a failure for the state to establish justice.Since you referenced the morality of the thing then you must figure there is a perfect system that is able to deal justly with heinousness beyond this life time. When a perp commits a crime that is beyond the limitations of human justice systems, capital punishment resolves the matter on Earth and puts it into the hands of a higher justice system that will have no difficulty resolving the matter perfectly.

Whether or not the perp is forgiven is really only in the mind of the victim(s). The justice system has no influence over the matter. Likewise with revenge. When/if you get that, you may see that the justice system has become bogged down in emotional and irreconcilable agendas. As you said that is not "blind justice" no matter who's view point you take.

Finally: Capital punsishment is not vengeful it is simply resolute. It should be available in the case of crimes that are not resolvable by human systems....unless you or anyone can show me a resolute alternative...and saying 'you' or the 'state' forgives the person does not make them "forgiven."
