That is a reasonable concern. I still think the system is stacked in favor of the defendant, and that therefore it is so unlikely that someone will be wrongfully executed that it is not an impediment to the practice, but it is worth examining the question of overzealousness.

The imperfections of the justice system cuts both ways....how many have been victimized by the failure of the courts to put away thugs for appropriate sentences?

We had a local state trooper killed by a POS that was less than 3 years removed from a attempted murder conviction....If we are to err, lets do it on the side of public safety....
