I did not invent the distinction, I merely elucidate it.

What kind of effectiveness are you looking for? It never claimed to stop all crime. It mainly reinforces the seriousness with which we regard certain transgressions, and thus helps us to internalize standards of behavior. Most people do not commit serious crime because they regard it as wrong, not out of fear of punishment, which is as it should be.

The fact that it is old might mean that it is outmoded, or it might mean that it is basic. People have known that 2 plus 2 equals 4 for a long time. Maybe the role of retribution is just as fundamental to any conception of justice......

ROTFL! As though you would even begin to be able to assess the alternate effect on the development of civilization, or lack thereof!

Being old does not make it right or wrong, but in the quartet of millenia since it was pronounced it has not proven effective.
