The DP sentence is delivered in a more cautious way than sentences for lesser felonies than murder. Most DP sentences that are overturned are done so after years of appeals and countless post-trial attempts to introduce doubt. Some of the overturned cases may indeed be innocents, but the vast majority, according to the Stanford Study, are overturned on technicalities and are resentenced to life in prison.

The lengthy DP appeals process is living proof that the system works to protect innocents from being executed.
