If one innocent is locked up then the same could be said.

Your argument is specious. You say that we have to dilute the penalty, when it is really the system that your argument attacks.

If we lock someone up who is innocent, it is still unjust.

If one innocent is murdered by someone who should have been put to death, then the system is flawed.

You cannot name one innocent who has been executed.
