Bad idea, to volunteer any information that doesn't simply and directly answer the question.

When you are asked the names of the employees, you should give the names of the employees.

Not only do you risk having your comments stricken (which I think would likely happen in a real courtroom) but you risk damaging yourself whenever you run off at the mouth like that.

And I'll bet you WILL run off at the mouth in a real court room.

You know, in this post I addressed what some people here have argued, two completely contradictory assertions:

1. There was no advice, no recommendations (i.e.Rea did NOT commit perjury saying this)

2. If you didn't take all the recommendations then really it's all your own fault

Now you can't have it both ways. I think a giant hole just got punched in the defense argument. They are going to have to decide which argument they are going to make, because if they say there was no advice then they can't at the same time say you did it yourself if you didn't do everything Rea said. And in the alternative, if they want to argue I'm responsible because I didn't execute every last rec - which would have been absolutely impossible save a gigantic account and at least a dozen or more traders executing - then they are logically barred from arguing it wasn't advice.

This is why this discussion is valuable to me. Now I am fully prepared for that argument, because it was raised here first. Just like every last argument in MB Trading's answer - the only one - was raised here 2 years ago by the Devil's Advocates.
