I was a trader. But, when addressing me as an opponent before the Court of Appeal, I am either Plaintiff, Petitioner, or Asser. You don't make a statement characterizing someone and use that to name them before the Appellate Court. Schwab counsel took a risk doing that, and I am sure the Court of Appeal has noticed. Maybe it's done at SI, but not before the Court of Appeal, which demands respect for not only itself and its Justices but also for all parties to a proceeding. It's not a playground. It seems Schwab counsel did not see it that way. Maybe it's because he has no manners, or has no experience at the Appellate level, or some other reason. In the end, he's a lawyer and he'll be held to certain standards set over the years. He did his clients a major disservice for pleading so.
