If it is the state, and the state claims to give equal treatment- because all men are equal before the law- then I do not see how you can have some men be more equal than others, before the law.

If it claims that all are equal under the law and some are not, then it is lying, and since the state is run by politicians that shouldn't surprise anyone...

Of course all of this starts with the assumption that gays are being unfairly discriminated against by the law. I made that assumption for the sake of argument because I wanted to deal with a response to a specific idea, rather then debate the whole subject. I'm just saying that even with that assumption I don't think the state is going after gays.
