We're arguing nits here, X. When marriage laws were passed, they weren't discriminatory. The question of impact on gays just wasn't an issue. Therefore, you cannot say that the law was actively discriminatory.

If, in more recent times, the laws are seen as discriminatory, I agree with you that it is active discrimination to work against changing them. Merely ignoring them, is not. That's not to say it's right to ignore the discrimination, only that it's passive, not active.
