True, but it is if the state is party to excluding you due to group identification.

Could you be more specific? What action are you talking about that makes the state a party to excluding who? If your talking about gay marriage laws I, perhaps mistakenly, thought you had accepted the distinction between active abuse and passively allowing a unequal condition to exist.
