So here we are denying formal unions for these women and their children Not really. As somebody pointed out recently, the only things that those lesbian couples can't voluntarily contract is social security benefits and one other thing, I forget what. There are many churches which will hold ceremonies of commitment for them and help them draft all the legal protections they want and need. In fact, they have more flexibility to structure their relationship than married people do. But they can't call their relationship a marriage.
