The danger does not appear if you have no power to enact laws. I chose that court decision and Mr. Chretien because Stephen mentioned that it would hurt the Liberals.
The Liberals received that new law as a decision rendered by the courts. If it really bothered Mr. Chretien he has the power to enact new legislation, which would then be struck down by the courts in due time if it conflicted with the Charter.

Indivuals can modify any law by challenge through the court system. In every case that is what happens. A law is challenged, the court agrees to hear the case and the decision can change the law.
