I can't because I don't know what her prior sexual activity has been. But lets expand that

What if:

She's had a history of being loose with the cabbage patch AND has shown a propensity to both lie AND be slightly delusional? Does this mean she wasn't raped? No. Does it affect how a jury may view her and thus bring up the question of credibility of the witness? I think it does. Does her willingness to have sex with others mean she wasn't raped? No. Does it raise questions about whether she'd say no to (and lets be honest) an NBA stud? I think it does.

So personally, whether law agrees or not, I think sexual history is germane to the topic.

Does that mean I think a chick who wears a mini is asking to be raped? Hell no! But our personal history and actions matter in ALL legal cases.
