Well then Lieutenant Governor Cruz Bustamonte would take over the job.

That is what I was expecting to happen all along. I'd be willing to place a bet in Las Vegas that we will see Governor Bustamonte. It is also interesting because Bustamonte is responsible for making several of the dececions that govern the special election. One thing that he might try is only allow the vote for the recall of the governor and not allow the vote for the successor. If he can get that through the courts then he will be the next governor.

But I don't think that that can cancel the whole special election now, because of Ward Connerly's Proprosition 54 the ammendment on Classification By Race, Ethnicity, Color or National Origin was placed on the special election ballot as well.

If Davis resigns now, the election goes on as planned. The California State Constitution specifically addresses this eventuality. Once a recall is certified, nothing stops the election being held. This was designed to avoid back-room deals allowing a corrupt governor, for example, to be replaced by an equally corrupt lt. governor.
