I cannot choose between the alternatives as you've framed the question. I don't think that the offense against states rights is in any way a function of the number of states involved.

Whether 'tis better to continue to adhere to FF&C or to create new law at the federal level that belongs at the state level is the real question, and, of course, that depends on your criteria for "better." I would consider the latter clearly more offensive to our system of government, including the principle of states rights.

Now if you asked which was fairer or more popular or easier or more sensible or some other criterion for choosing between the options, then the answer would be different. But as far as states rights goes, this is a no brainer.
