That seems to me to be unduly confrontational.

I can understand that. It's much like my reaction to the constitutional amendment on marriage. What we don't know is what transpired prior to legal action. We don't know if any attempt was made by either side to come to an understanding or if one side just came out swinging. To much coming-out-swinging going on in the world. If there is an attempt to negotiate some civil resolution of the issue and that attempt is brushed off by those in power, then I don't think it unreasonable to go to the courts if there is likelihood of the courts siding with you, as the court did in this case. I think it is a terrible shame, but I can't find it unreasonable, and I think the authority figures have a good share of the blame.
