I see three issues that are getting twisted around each other to an extent.

1 - The judge himself.

2 - Should the TC have been in a court room.

3 - Is it unconstitutional to have them put in a courtroom.

I think the arguments against considering the judge as a man of careful consideration, fairness and wisdom, and the arguments against have the TC in a courtroom, are stronger then the argument that they are unconstitutional.

Edit - CH expressed it well

2nd Edit - But I think at this point he should take down the TC or resign.

Here is an interesting resource for kids and parents dealing with middle school, high school and college, and I thought I would share it with you. The reviews seem to be generally accurate- though obviously one enraged student might blast a teacher- however, patterns certainly emerge, and I am checking all the teachers my daughter gets against the comments on Rate my Teachers. If you find your child has a teacher with a very bad rating, it might behoove you to see if you can switch your child's schedule. That is what I would do.
