To: axial who wrote (12818 ) 8/24/2003 12:46:32 PM From: wilyolvet Respond to of 14101 Jim: shame on you ...you said "My main purpose in the last few months has been to .... simultaneously work the boards with the purpose of spreading fear and discontent among DMX investors - to a degree exceeding their already legitimate fears." JIM: it is really sad that your life has turned to the above ....you said "Identifying the houses at work was no real problem, but what was needed was for someone to step forward and say, "Yes, that is what we're doing." JIM: i don't know who is selling but i do know that the people that you refer to as pros are not the ones selling ....you said "So, if wilyolvet was to publicly acknowledge his part in this scam, it was necessary to goad him into anger. The handle suggested the best way to do this was to contradict the very image he was trying to project. So, I'm afraid I spoke poorly of you. I laughed at your "professionalism" and called you, and the people you were working with "clowns". I derided the intention to eliminate management, when you had no satisfactory alternative. I called you "fools". It was done with the intention of having you acknowledge your part in the scam - and it succeeded. Nothing personal: just a means to an end. JIM: shame on you...your own admission in the above paragragh simply confirms why i have taken the time on a couple of occasions to call you an idiot....you have proved nothing other than you are a game player who intentionally tries to lie and deceive...there has been about 100 occasions where i wanted to respond to your stupidity but simply didn't bother(i take that back as you indicate that you are not stupid but that your appearance of stupidity was just a mask for duplicity) JIM: if you wanted to know what was going on, you simply had to ask as opposed to behaving like such a moron...those that have pm'd me or emailed me have been given whatever information that i have had openly and freely because there is nothing to hide JIM: now that you have laid out your "interesting" agenda, i would be happy to address you conspiracy theory....mgmt promised to have a new ceo in place by the end of the RO...mgmt reneged on its promise and informed the street that it wouldn't have a new ceo in place so the street walked on the RO...mgmt also told the street that it would get right back to them with a pp once the new ceo is in place...of course, nothing has happened the individuals on the street that are responsible for large share holdings must be able to communicate openly with mgmt...mgmt simply refused to take calls from the street after the RO....i don't know of one other public company that has turned its back on those that support them the way dmx has done....why do you suppose TS put the 900,000 shares up for sale and why do you suppose he eventually removed the offering....there are a very small group of brokers that control a large number of shares that are very concerned with the erratic and highly unusual behavior of the ceo...the brokers don't want a lynching and they don't want to take over the company...they simply want dmx to install a new ceo that the street can trust because the street hates the existing ceo there are a lot of good stories out there and dmx is only one of them....unfortunately for dmx shareholders, the existing mgmt is totally paranoid of the street and we as shareholders have suffered for this paranoia...the street has a set of unwritten rules or a code of ethics and the mgmt at dmx has broken every rule and violated all ethics when it comes to the street JIM: i don't know who is selling and neither do the people you call pros....none of your so called pros are interested in driving the price down to take over the company or obtain a large position at low prices...in fact, the so called pros won't invest another cent in dmx as long as the current ceo is in place...the pros are hurting much more severly than the retail holders because the pros are not only invested personally, but they have hundreds if not thousands of others that have invested in dmx on their advice and they must go into work each day knowing that their clients are losing and it is all because the pros took a chance on dmx...what is worse is that the mgmt at dmx won't supply any info and the stock is so illiquid that the guys can't get their clients out after speaking to mr ho last week and i have decided that it is time for me to move elsewhere...either mr ho was lying to me or dmx is even more pathetic than i imagined....i indicated to mr ho that i believed that we could get mr cloutier on board based upon my information and i indicated that i was fairly certain that i could assist the company in raising $30 million of equity very quickly if mr cloutier was in fact on board...mr ho indicated that the existing management was not looking for a replacement and that the company was actively searching for money on its own....the fact that dmx wouldn't want one of the top pharma execs in the country to replace the current pariah and that they thought they would be fine muddling through on their own with wacky financing tricks was enough for me to make my exit decision individual shareholders have to take what they get except for one time each year when they can express their opinion through voting...i don't think there is the will to make changes by the existing shareholders because we all somehow feel that the "drugs" will save the day.....perhaps the drugs will eventually save the day, but the company will always be grossly undervalued as long as the current ceo is in place...once dr. kuhne receives his next batch of shares, i don't think that there will ever be another opportunity to force a change in mgmt when i am in a position that i feel powerless to have any effect on my investment, then i must look to mgmt to see if i trust them and their judgement...my decision has been made and won't change unless we see a new ceo...everyone else can make their own decision i will take whatever funds that i receive from the proceeds of the sale and place them in a situtation where mgmt understands the rules and the ethics and is willing to work with the street JIM: your efforts have been extremely transparent to almost everyone...i don't agree that the end justifies the means no matter what the cost and as such, you and i will likely never agree...if you think that you have won something here, then good for you but the information has been available all along to anyone that asked....i don't like criticizing anyone because criticism is typically very painful to hear unless one is a very strange creature....i have felt it necessary to criticize you because your blatant attempts at misinformation and fear mongering actually hurt people....while you criticize the street, i think you should have worked on the street because you surely exemplify the qualities of the street that you attack in terms of lying and manipulating and justifying it all by saying the end justifies the means there is no point in me posting any further because i am walking away from dmx...i'm really excited about my new investment opportunity and i am hopeful that i will be able to recoup my losses from dmx in the coming months as the new company also has a remarkable story but it also has a well thought out gameplan and is working with the street while i could be bitter about my dmx investment, i would rather use the experience to help me with my decision making for future endeavors...the error was mine as i now realize that the paranoia displayed by the ceo many years ago should have made me walk away good luck to all
