I believe it's as simple as grandfathered or not. Before you had to meet x percent. After some date new or refurb of some percent of total value means you have to meet Y percent.

Y may be 1/2 or 1/4 of X in pollution. But reaching 95 percent of the reduction of Y is not allowed. And allowing anyone to only achieve 95 present of Y is increasing pollution.

It's a mentally retarded way of thinking and pure vacant liberal minded lefty loon.
