I wouldn't call it eccentric at all. A literal reading of the constitution would probably favor Keyes's interpretation. That doesn't imply that such incorporation isn't well established, just that it may be established on a shaky foundation.

Could you reduce the issue to it's concise essential interpretation. Are we still talking about whether or not a religious artifacts, symbols, or language may be presented in a court?
