A big rock with "There is no God" would scream that, and THEN the religionists could say it was the same. But absence?

If it were simple absence, then I would agree it's not the same. But there is historical precedent at play. Not allowing the TC, in that context, is not simple absence, it borders on removal given that the status quo is always the default.

Now, this particular rock didn't have any history. It was virtually hurled at folks like you and me. Shame on Judge Joe. But I can see how, in general, not allowing the TC somewhere it has some history could be perceived as other than simple absence.
