The understanding I was given by Admin Jeff was that posting PMs was not a TOU violation UNLESS the sender had specifically requested confidentiality. Is this also your policy?

No. The reason is that someone could include a boilerplate request for confidentiality at the end of an abusive, threatening tirade.
