It's easy to say there should be a bright line. And sometimes there are. No said with no conflicting actions is always no. Using drugs or physical force is always no.

With at least drugs there can still be a conflicted ambiguous situation. If one person drugs the other without their knowledge to cause them to be unable to resist sex then it is rape, but if both people are taking drugs together and they have sex I don't see how that makes it rape even if they probably would not have had sex without the drugs. If the drugs did make it rape in that case then both partners could claim they where raped.
