Amendment VI

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

Now:
I give you double jeopardy. He hasn't had single yet, so how can he have double?

BUT: Where did habeas corpus go? Speedy trial? Public trial?

The guy was caught in the UNITED STATES, not Afghanistan. Shouldn't he be in civil court? How did the military get into this?

(And, yeah,I know some would-be German spies were caught during WW2 and secretly tried by military tribunals and executed. Was that legal? And another difference is that there had been a declaration of war against Germany. We never declared war against Afghanistan.)
