You, of course, already know the counter-arguments so please forgive me if I don't make them.
I do? I know of no argument that would make this acceptable:
If the Bill of Rights do NOT apply to non-citizens, then it would seem legal to dispense with the trial; just bust 'em and shoot 'em.

And we're not at war. The administration wants to have it both ways. It wants to use secret military tribunals such as might be employed in wartime, but it does NOT want to consider the prisoners in Guantanamo POWs because then the Geneva Convention applies. It wants them in some non-category called "illegal combatants".
