I agree that rape and jail time are too stiff a penalty for the mistake made. But there are always those who suffer penalties as society learns. The first guy who ate a new plant that the tribe found sometimes died. That's the way the world works. We must learn to take responsibility for what we do and exercise due caution. Avoiding that jail sentence is entirely avoidable. And it is virtually entirely avoidable with just reasonable care. It is only unavoidable for libertines, narcisists, impulse-control impaired and the like. Just like STDs, that jail time is avoidable.
