It would only happen if a potential black client approached them and was told no and and either was told it was because they were black

No it could happen if a couple of potential black clients where turned down and no black clients where accepted. Courts have used statistical and other evidence much less direct then "he said he wouldn't do business with me because I am black" to enforce discrimination claims.
