David, I thought the point of contention between Bob and mmmary was whether the account that is now labeled "hijacked account" was being used by mmmary or not.

My point was if the account owner was a friend of mmmary and had used her computer to make the posts, would that not leave the same IP trail as if mmmary had made the posts herself? In other words, the TOU regulates individuals but not which computer that individual can use.

Now if the account owner has been contacted and it has been verified that someone indeed hijacked their account, then that would be actual proof. But if the account owner is contacted and says they have been posting on their own account using mmmary's computer then it would seem no foul was committed.

At least that's my understanding of the Terms of Use Agreement.
