Re: attnys, I've heard the original purpose of the judge was never to hand down sentences. The jury's job was to not just to observe, but to ask questions, be involved, and make decisions on BOTH the case and the gov't law itself including deciding the sentence. I.e., if the gov't makes bad law the jury's duty is to pass judgement in that case. The idea there is that the gov't is vastly more dangerous than a few little criminals.

That's even more difficult conditioning to break. We've got a steady progression of centralization of authority, from jury of peers, to the prosecutor having authority to keep the jury out of the picture, to the judge handing out sentence, and soon to the federal gov't having control over judges. That will be next.

The tribunals + Patriot Act declaring all crimes to be "terrorist" accomplish that already, giving discretion to the President alone, to find, prosecute, convict and execute anyone in secret, keeping even evidence of the process secret.
