I'm only touchy because I dealt with both the issues you brought up.

It's really quite simple.

If there are reasonable grounds for refusing to serve people, it doesn't matter what color their skins are.

But if you take two people who are functionally equal in terms of the services you offer, and serve the white one but reject the black one, or vice versa, and keep doing this over and over, then you have made a presumptive case of discrimination.

In the application of the principle you of course get into issues like what is pretext and what is legitimate reason, etc., but the principle is really amazingly simple.
