Whenever the Justic Dept gets power they overextend it and frequently get the power revoked. Pretty sad really. The ATF used to do the same thing on firearms but had some of their abilities to ensnare the innocent taken away from them. Look at the overextensions of power at Ruby Ridge and Waco, neither on the Republicans watch and prior to the Patriot Act. Look at how Janet Reno had Elian Gonzalez taken away from relatives in Miami with thugs with machine guns and full military equipment and uniforms. You're probably right but now Bush wants to extend its power which is causing more people to be up in arms.
