Society maintains its role in judging the issue

In what forum would you expect that judgment to take place? A legislative body? More likely a court room. And would it take place before or after Mojo implemented his policy? If X and I sued him to force the issue, of course, then it would take place in a courtroom after the fact.

It is incumbant on the person of conscience to qualify his position.

Society could set up a procedure where he could get permission in advance, I suppose. Perhaps the bureaucracy could have administrative judges to hear petitions for exception. What kind of fee would be charged for the petition? Would there be briefs filed or would an independent entity gather data for an impact statement? I assume that the petitioner would submit his side in his petition and the state would evaluate the impact and make a recommendation on whether or this would be a net benefit to society.

Interesting idea. Never happen, but interesting nonetheless.
