The judge can rule on whether or not you and X's case should be dismissed in light of the ALJs decision.

No, I disagree. Once the suit has been filed, it's in the hands of the court. Now I suppose the court could ask the ALJ for an opinion on the belated petition and then include that in his ruling, but the judge hearing the suit is in the driver's seat. Anything less would not be fair to the complainant.
