I don't see it even glaring at the first amendment, let alone flying in the face of it. Someone can burn a flag in the park if he wants to. But he can't burn it in my living room and claim first amendment.

I have been doing the same thing...Ask them their name...then have them spell it...then ask the name of the company they are calling for. Then tell them this isn't a good time to call, and for them to take your name off their list.

If you have a little time on your hands you can have fun with these people. I've had two of them hang up on ME recently. I consider that a minor coup. <g>
