If the constitution is only a framework and not a blueprint, then in reality we don't really have a constitution at all and therefore you also don't have a right to free speech, religion, protection from searches and seizures, arrests etc

The Constitution simply provides a framework, meaning that it provides the 'bones' and not the meat. The purpose of the legislative branch is to provide that meat, by passing the specific laws that adhere to that framework. That is the beauty of the Constitution. The EU has failed to create a similarly beautiful framework because they have failed to understand the difference between a framework and a set of laws.

Part of the power that Congress derives from the Constitution is the ability to pass legislation. Legislation that creates the necessary government laws and entities to provide service to the people. If our elected representation decides that a Dept of Education is a beneficial service to the nation, then they have the right to do so, since it is not expressly forbidden by the Constitution.

Remember, the Constitution does not grant rights, it protects them.
